12/11/25 Update

Track Line Commits in Writing to Remove Ties - Timeline To Be Determined

On 12/11, Kathy Bryant, Marion County Commissioner, shared with RRC some very welcome news from the County's Assistant Attorney, Linda Blackburn. While this is an incredibly positive step, questions remain, and vigilant monitoring and follow up will be required until the last tie is gone and the contaminated environment returned to its original, or an improved, state.

RRC thanks the County Attorney's office and Ms. Blackburn for her laser-focused determination and efforts to prevent the tie shredding operation in Marion County, and to see this through until the final toxic tie is removed and a safe environment has been restored for the Dunnellon and Chatmire communities and the Rainbow River. 12/10 Status Update from Assistant County Attorney, Linda Blackburn, Marion County

Greetings! 

I just spoke with J. Patrick Dover, Senior Counsel for CSX, who assured me that they received confirmation, in writing, from Track Line Rail, LLC, that the railroad ties staged on the CSX Property in the County and City of Dunnellon will be expeditiously removed.  CSX has provided 22 rail cars to Track Line Rail, LLC, which should be arriving this week.  The rail cars will be filled with the railroad ties and shipped north, out of state.  The 22 empty cars will then return to pick up more loads of railroad ties, and the process will repeat until all railroad ties are removed.  Mr. Dover advised that they were unable to come up with a date certain that all ties would be removed, as CSX was waiting to see how long was reasonable for Track Line Rail, LLC to load, ship, off load, and return to load again, before a time certain was put in place.  I will follow up with Mr. Dover after Christmas to see if he is able to provide me a more static timeline. 

I also asked him whether there were any plans to conduct any soil or water quality testing after removal of the railroad ties.  This was a request of Terrell Arline, Esq. who represents the Sierra Club, Rainbow River Coalition, and Chatmire.  Mr. Dover advised that they had not thought of that aspect in their negotiations with Track Line Rail, LLC but he agreed that he would check with CSX’ environmental department as to what they could do or recommend.  I advised Mr. Dover to let me know their response and he agreed that he would do so.

Finally, I confirmed with Mr. Dover that so long as Track Line Rail, LLC was, in good faith, moving the railroad ties out of the City and County as quickly as possible, that the County would not initiate any legal action for that very thing.

Sierra Club Applauds Decision to Remove Toxic Railroad Ties

Grow that CSX Transportation Inc. will remove the stockpile of creosote-treated railroad ties from the Dunnellon/Chatmire community. This action marks an important step toward protecting residents’ health and safeguarding the Rainbow River and surrounding ecosystems. See their full statement here.

We have a lot of news to share, so get comfortable and start reading! Yesterday was a hectic rollercoaster of a day!!

 

Good News from the 12/04 meeting in Chatmire

Last night’s meeting in Chatmire was nothing short of amazing! A near standing-room only crowd filled the church, and the unity of common purpose was palpable. Planned speakers were Mayor Walter Green, Bill White (VP RRC), Karrin Gordon (RRC), Rev. Eric Cummings (Marion County School Board), and Rev. Jerome Gamble (Marion County Branch, NAACP).

At the start of the meeting, Florida State Representative, JJ Grow, made a surprise appearance to deliver much needed good news: At 3:00p on 12/4, CSX called Mr. Grow and promised to remove the ties! Mr. Grow had been in regular contact with CSX over the past many weeks, also speaking with Marion County Commissioner Kathy Bryant and Dunnellon Mayor Walter Green on a near daily basis, all working together on the railroad tie issue. When CSX stated they would be developing a transportation plan to remove the ties, Mr. Grow expressed his expectation of swift action by CSX. He further stated that Marion County Attorney’s Office had planned to file an injunction due to the missed 12/3 deadline for removing the ties, and has agreed to hold the injunction until sometime next week to allow time for CSX and Track Line to begin removal.

This was very late breaking news (just three hours before the meeting) and many questions must still be answered:

    1. When will the ties be removed? How long will it take?
    2. Will CSX clean up the contamination once the ties are gone?
    3. Who ensures cleanup is completed properly?
    4. How can we ensure something like this never happens again in Dunnellon/Chatmire?
    5. How will people suffering health issues as a result of the toxic fumes from the ties be helped?

RRC followed up with the County Attorney on 12/5 to learn additional details of note:

    1. CSX has promised to contact Track Line, to push Track Line to remove the Ties. CSX is not (currently) planning to remove the ties themself. If Track Line fails to remove the ties, CSX will act on the removal. Track Line owns the stockpiled ties.
    2. CSX has not yet committed to this in writing. The attorney is working with CSX to obtain a written commitment.
    3. CSX leases their property to Florida Northern Railroad, and it was Florida Northern who allowed Track Line to stockpile the ties.
    4. CSX ‘s attorneys were surprised by the material sent to them by Marion County’s attorney: City and County Inspection reports, Code Violations issued, photos, videos, public comments and complaints, etc. Ultimately, one CSX project manager involved with the Track Line project was fired this week (mentioned by JJ Grow and independently confirmed by RRC).
    5. If the County chooses to file an injunction next week (an injunction is a law suit), the injunction will be against Track Line, but will have to include CSX as well, because CSX owns the property. There is some reluctance to jeopardize CSX’s current level of cooperation by filing suit, so the County will be working closely with CSX in the next week to determine next steps.

 

What you can (and continue to) do:

    1. Continue (or start!) journaling your observations of air conditions, health symptoms, and activity on/around the tracks. Be sure to note:
      1. Date and time of day
      2. Weather at the time (temperature, precipitation, wind direction and strength, etc.)
      3. Whether it is an odor, an irritant, loud noises, vibrations, lights or something else. Also note how strong it is. For example, “Outside for 10 minutes and my eyes started burning so badly I had to go indoors, 9/10.”
      4. If you can, note when the odor/irritation/noise stopped.
    2. Take photos/video of activity on/around the tracks and forward to Kathy Bryant. Don’t trespass on CSX property!

A Sobering Assessment from Marion County Fire and Rescue

“The railroad ties, as stored now, present an extremely high fire load in a location where access becomes limited once a fire is fully involved. Any suppression effort would create contaminated runoff, while allowing it to burn would expose the community to prolonged toxic smoke. Either choice carries unavoidable environmental and public health impacts.”

12/04 Update on FDEP activities

Track Line’s Air Permit application

    1. None of the three parties (Marion County, City of Dunnellon, Sierra Club/RRC/Concerned Chatmire Citizens) who had requested extensions filed a petition for an Administrative Hearing by the 5:00pm Monday, 12/1 deadline.
    2. FDEP Air is now evaluating public comments received before 5:00pm 10/31 and other information so they can choose one of three actions for Track Line’s Air Permit application:
      1. Deny/reject the Air Permit as currently written.
      2. Issue/approve the Air Permit as currently written.
      3. Modify the Air Permit based on their evaluations. If FDEP chooses to modify the Air Permit, the cycle will repeat, requiring a Public Notice and 30 day Public Comment Period, with options to request Extensions or Administrative Hearings.
    3. FDEP expects to make their decision by Christmas.
    4. Once the decision is made, anyone who emailed public comments will be notified by email of the decision.

Track Line’s Stormwater Multi-Sector Generic Permit (MSGP)

    1. Track Line did obtain a MULTI-SECTOR GENERIC PERMIT FOR STORMWATER DISCHARGE ASSOCIATED WITH INDUSTRIAL ACTIVITY. The discharge location explicitly states “Rainbow River (BlueRun)” as the “receiving water name”.
    2. MSGPs are basically a rubber stamp process: if one is requested, it is issued. However, once issued, FDEP steps in to ensure an appropriate Stormwater Pollution Protection Plan (SWPPP) is documented. Track Line’s SWPPP has not yet been approved by FDEP.

General description of how FDEP operates:

    1. The Head Office is in Tallahassee, and oversees all District Offices.
    2. Florida is divided into several Districts. Marion County falls under the Central District Office’s (CDO) oversight. The CDO is located in Orlando.
    3. The Air Division issuing permits only exists in Tallahassee’s Head Office, there is no Air Division in the District Offices.
    4. The District Offices are predominantly focused on Compliance and Enforcement.
    5. District Offices are responsible for understanding the “big picture” of a given project, ensuring the separate FDEP permitting divisions are impacting one another appropriately.
    6. District Offices must investigate credible complaints of “objectionable odor”. This type of complaint investigation does not have to be related to a permitted project/source, meaning that a project does not have to have approved permits in order to be investigated for objectionable odors.

FDEP’s first Dunnellon/Chatmire site visit occurred 11/21/25

    1. The Deputy Director of Tallahassee Air and the District Director of CDO visited the CSX property, and drove through the Chatmire and Blue Cove neighborhoods.
    2. At the time of their visit, they did not detect odors extending beyond the CSX property. There will be additional site visits, occurring at different times of day and in different weather to account for atmospheric influences on odors and airborne irritants.
    3. Their main purpose for this first site visit was to observe first hand the stockpile of ties. Even though they’d seen photos and drone video, they were surprised at the magnitude of the stockpile.
    4. Observations noted unpermitted swales and conveyances not mentioned in Track Line’s MSGP, and will require additional ground work to determine how these geographic features manipulate stormwater.
    5. If Track Line’s Air Permit is approved, their MSGP and SWPPP will have to differentiate between stormwater/runoff from the shredding operations, and stormwater/runoff from the storage of the intact ties, because different regulations apply to each situation.
    6. CDO’s Solid Waste division will also be involved with future site visits and compliance reviews.

FDEP’s next site visit will focus on Water Resource Management issues, in relation to Track Line’s MSGP and SWPPP

 

12/04/25 Update

12/02/25 Update

There are two significant deadlines this week:

    1. Those who had requested an Extension for FDEP's permitting process for Track Line's Air Permit application had until 5:00pm Monday, 12/1/25 to file a petition for an Administrative Hearing.
    2. Marion County gave Track Line and CSX until 5:00pm Wednesday, 12/3/25 to remove all railroad ties from the Dunnellon/Chatmire area.

We likely won't hear of any definitive outcomes from these deadlines until next week, so stay tuned!

11/22/25 Update

Both the City of Dunnellon and Marion County have taken additional action against Track Line Rail, CSX Transportation, and Florida Northern Railroad Company. RRC continues to work with our attorney, in partnership with Sierra Club and Concerned Citizens of Chatmire. While these new actions bring hope, many obstacles remain, and legal processes take time. It is imperative for concerned citizens to respond to our CALL TO ACTION to contact your local elected representatives expressing your opposition to this situation. 11/18 Update from City of Dunnellon

On 11-18, the City sent a notice to CSX & Track line for a Special Magistrate hearing since they did not comply with the city's notice of violation remedy. The hearing will take place in January 13, 2026. The public is welcome to attend, but there will be no option for public comment. Find out more about the powers of the Special Magistrate here.

11/18 Update from Marion County

On 11-18, Marion County sent a second notice and noted in the letter that they intend to file an injunction within fifteen (15) days with the 5th Circuit. They have also talked with Florida Northern and CSX officials (Mr. Walker Brazell, Property Manager for CSX). Mr. Brazell said that they are “pausing all activities on the property.” However, they are not taking action to remove the ties until they can connect with their legal counsel about jurisdictional questions of whether their activities are preempted by Surface Transportation Board (STB) authority over rail service. Our legal team has researched the issue and found case law in Florida that specifically addresses this issue and does support local jurisdictions having authority in cases like this where it is a contractor (i.e., Track Line in our case) doing work unrelated to “transportation” – i.e., the stockpiling and potentially grinding rail ties.

Additionally, the County’s Code Officer inspected the site this week and it appeared that they have moved more rail ties within the city limits.

11/18/25 Update

Last night, at their 11/17 General Membership meeting, the Rainbow River Conservation (RRC) Board voted unanimously to unite with Sierra Club and Concerned Citizens of Chatmire to protect the Rainbow River, our environment, the health and welfare of area residents, and the interests of the surrounding business community.

After consulting with Sierra Club’s attorneys and subject matter experts in environmental law relevant to contesting Track Line’s Air Permit application, RRC’s attorney advised that challenging FDEP’s issuance of Track Line’s Air Permit would be complicated and expensive to litigate.  Instead, we will pursue land use issues at the local level to oppose Track Line’s shredding operation in Chatmire.

The Marion County Board of County Commissioners (MCBCC) has already informed Track Line that it must request a Special Use Permit in order “to store, shred or grind used ties on the properties”.  The Sierra Club has retained Terrell Arline, Attorney to represent the Sierra Club, Rainbow River Conservation, and Concerned Citizens of Chatmire in any potential public hearings held by Marion County to consider zoning, land use, special use, or comprehensive plan change applications submitted for the project. .

Our first CALL TO ACTION was for concerned citizens to contact FDEP’s Air Division to oppose Track Line’s Air Permit application before 5p on 10/31. The community response was overwhelming! An FDEP contact shared that they had never before received so much public opposition to an air permit application!! If you provided your email address when you contacted FDEP, you will be notified by FDEP about their decision on Track Line’s air permit (sometime after 12/1/25).

This brings us to our second CALL TO ACTION. We now ask you to contact local elected representatives with your concerns about this proposed 24x7 creosote tie shredding operation.  RRC believes that it does not belong in the Rainbow River watershed or next to the adjacent residential communities of Chatmire and Dunnellon. We need to ensure our local authorities are fully aware of our environmental and quality of life concerns regarding this project.

I respectfully request that the Marion County Board of Commissioners reject any proposed railroad tie shredding operation in the Dunnellon/Chatmire area. I also respectfully request the immediate removal of the massive stockpile of railroad ties currently along the CSX tracks from W. McKinney Ave to E. McKinney Ave in the City of Dunnellon and Chatmire, Marion County.

11/11/25 Update

Thank you to all who contacted FDEP with your concerns about the railroad tie shredding project currently targeting the Dunnellon/Chatmire area! As of 10:30a, Friday, 10/31, an FDEP contact shared that “around 200 complaints” had already been received, with several hours yet to go before the Public Comment period closed. Apparently, this high volume is unusual for an air permit. Way to go Rainbow River lovers and Dunnellon/Chatmire residents!!

We’re happy to report that Sierra Club/RRC’s request for an extension has been granted by FDEP. We now have until 12/1 to decide whether to pursue a petition for an Administrative Hearing with FDEP, to legally contest Track Line’s Air Permit application. Filing a petition for the hearing is a legal action. Our attorney is currently evaluating evidence and consulting experts to decide if our case has enough merit to move forward with the legal process and has a few more weeks to determine our next move.

In the meantime, Marion County’s attorneys are in touch with Track Line and their affiliates, CSX and Florida Northern, to gather more information and explore resolutions that would avoid litigation altogether.

WHAT YOU CAN DO NOW:

    1. If you live or conduct your business close enough to the stockpiled railroad ties to notice odors, eye/throat irritants in the air, or excessive noise from activity near the tracks, start keeping a diary noting your observations. Be sure to include:
      1. Date and time of day

      3. Whether it is an odor, an irritant, loud noises, vibrations, or something else. Also note how strong it is. For example, “Outside for 10 minutes and my eyes started burning so badly I had to go indoors.”

    1. If you have a drone or another high vantage point, take regular footage/photos of the stockpile and any activity near the tracks. Be sure to note the date and time of the footage/photos. Footage and photos from the ground are also useful but be careful not to trespass on CSX property. The objective is to show changes (or lack thereof) over time.

Note: We are also interested in footage/photos taken in July or August, before the accumulation of ties began. Having evidence in that timeframe showing bare ground without huge piles of ties would be very helpful.

With fears for my family’s health and irreparable damage to the environment and the sensitive Rainbow River watershed, I strongly oppose Track Line’s proposed operation in Marion County and request that FDEP deny Track Line’s Air Permit No. 0830196-001-AC. I further request the immediate removal of the railroad ties from Marion County due to the health and environmental risks raised by their simple presence, in compliance with Marion County’s Code Violation issued to Track Line and CSX last week.

10/29/25 Update

10/29 Update from Tim Innskeep, Dunnellon City Council:

Yesterday, we discovered half of one of the parcels the rail road cross ties were dumped on is within the city limits.

Once that was realized, Dunnellon city code enforcement created notices of violation that were sent out today to both CSX and Track line (notices are attached).

Today Mayor Walter Green signed both a letter of permit denial and request for extension (which temporarily halts progress on this horrible project) both were sent today to the FDEP, Governor, Lt Governor, our state & county representatives (letters are attached).

I had the opportunity to meet with Kathy Bryant and Asst. County Administrator Tracy Straub in Ocala yesterday evening, both are all over this issue.

As this progresses, Mandy will be Cc'd on all county correspondence and likewise, Kathy & Tracy will be Cc'd on all city correspondence to ensure each party stays informed and coordinated with the other.

10/29 Update from Rainbow River Conservation (RRC)

Rainbow River Conservation (RRC) Boad members voted to file their own FDEP Extension Request. The Florida Chapter of the Sierra Club has voted to cover any legal expenses on RRC’s behalf, although to finalize this funding, including a possible court challenge, the National Chapter must approve the legal expense obligation and that has not yet occurred.

In the meantime, an environmental attorney affiliated with Sierra Club will assist with the Extension Request at no expense to RRC. Several residents of Chatmire have agreed to partner with RRC on this Extension Request.

What the FDEP Extension Request will do:

    1. It puts FDEP’s approval process for Track Line’s Air Permit application on hold until the requested extension period expires.
    2. It gives RRC and other entities more time to respond to this crisis.
    3. It allows RRC to retain standing to ask for a Public Hearing (beginning of the litigation process) if need be.
    4. FDEP will waive all rights to public comments, requests for extension, or filing for a Public Hearing if no action is taken to extend their deadline of 10/31.
    5. Other entities, individual or governmental, can also file for an extension on their own, allowing them time to request a Public Hearing (beginning of the litigation process) should they choose to do so.

10/27 Update from Dunnellon City Council

City Council provided the following FDEP contact information, encouraging all citizen’s to call and email their concerns and objections about Track Line’s creosote-laden railroad tie shredding and grinding operation in unincorporated Chatmire, Marion County BY FRIDAY 10/31, which is the deadline for public comment:

At the meeting’s 1:18 mark, you can listen to Kathy Bryant, Marion County Board of Commissioner recap the efforts underway by Marion County. The following information was summarized from Ms. Bryant’s remarks:

Because the shredding site lies within the unincorporated area of Marion County, Dunnellon’s Mayor and City Council do not have jurisdiction.

Actions already taken by Marion County:

      1. County Code Enforcement Officers visited the site last week.
      2. A Code Violation was issued to Track Line, copying CSX, giving them 14 days to remove the railroad ties.
      3. Track Line and CSX were also informed that even if the FDEP air permit is granted, they are not within their rights, per the Marion County Land Development Code, to set up this operation on the property they have targeted.
        1. The parcel is owned by CSX, but has a land preservation land use and an agricultural zoning use, which means the proposed railroad tie shredding and grinding operation does not fall within the Land Development Code.
        2. Track Line would have to go before the Marion County Board of Commissioners and make application for a Special User Permit in order to be allowed to operate the shredding facility on this site. There are many hurdles required to obtain a Special User Permit from the County.

Marion County’s next steps:

      1. The County Commissioners’ legal department is reviewing all material, including letters from Dunnellon City Council.
      2. There will be correspondence coming from the County regarding the FDEP air permit, and those letters will have to go out by the end of this week to meet FDEP’s deadline for public comment.
      3. If Track Line does not remove the ties within the 14 day period specified, the County “will start liening them and we’ll go to court and seek an injunction. I mean, we will take this as far as we have to do, and we’re going to make sure that in our correspondence we let them know that.”
      4. Kathy Bryant assured City Council and the audience that she would be “move aggressively with everything in her power so that this operation does not happen at this site. It is absolutely 100%, it is not a location that is suitable for this type of activity.”

     

10/24/25 Update

On 10/24, Marion County issued a Code Violation to Track Line, also advising them that they would need a special use permit to proceed with building the shredding operation.

  

Background

On October 17, 2025, FDEP issued a PUBLIC NOTICE OF INTENT TO ISSUE AIR PERMIT in the Riverland News. Because Track Line’s permit application categorized the Dunnellon/Chatmire railroad tie shredding operation as a minor source of air pollution, FDEP allowed a 14 day period for public comment, requests for extensions, and requests for hearings. In contrast, an operation such as a cement kiln would be considered a major source of air pollution and would therefore require a 30 day public comment period.

A concerned citizen saw the Riverland News Notice and brought it to the attention of Dunnellon City Council on 10/20. City Council began investigating and were alarmed by the long list of pollutants noted in Track Line’s FDEP Air Permit Application. They contacted Marion County inquiring about potential County permitting requirements and also contacted RRC with their concerns for the Rainbow River. They scheduled a special off-cycle City Council meeting for 10/27.

In their FDEP Air Permit Application, Track Line described the project as follows:

“The proposed project involves the installation and operation of a facility to shred and grind creosote-treated railroad ties (CTRT) into a 1-inch minus fuel product for shipment to cement kilns permitted to use the material as a beneficial secondary. Operations will employ two mobile, track-mounted Tier 4 diesel-powered units—a shredder and a grinder. All processed material will be loaded directly into live bed trailers (trucks) beneath a mobile dome canopy. There will be no outdoor storage of processed product; material will be shipped off-site immediately upon completion of processing or once trailers are fully loaded.”

The Air Permit Application made no mention of the thousands and thousands of creosote-laden railroad ties already stockpiled on CSX-owned property in the City of Dunnellon and Chatmire, Marion County. Subsequent investigation showed that the stockpiled ties are sitting on land zoned as Agricultural, Land Preservation, Low-Density Residential, and Medium-Density Residential, and some of these parcels are also in a designated flood plain (see the Code Violations issued by both Marion County and the City of Dunnellon in the dated updates above). This drone footage shows the magnitude of the stockpiled creosote ties.

It was then discovered that Track Line had previously set up their shredding operation in Newberry, Alachua County, earlier in 2025. The City was able to evict them from Newberry due to a lack of proper permitting. Track Line had learned a lesson and submitted their FDEP Air Permit Application in August for their new operation targeting Dunnellon/Chatmire. They then began quietly transporting thousands of creosote-laden railroad ties to Dunnellon/Chatmire, while local authorities and citizens were completely unaware of the magnitude of the accumulating ties, or the planned shredding and grinding operation. On 10/23/25, the Ocala Gazette reported on Dunnellon City Council’s agenda for the 10/27 Special City Council meeting. Rainbow River Conservation (RRC) leveraged both their website and Facebook page to get the word out about the 10/27 meeting. Concerned Dunnellon/Chatmire citizens and other interested parties flooded Dunnellon City Hall on 10/27 with a standing room only crowd that spilled out of the building into the parking lot. See the recording of the 10/27 meeting and the many concerned speakers here. City Council shared FDEP’s contact information at the meeting. RRC issued an Urgent Call to Action on their media sites, urging citizens to call and email FDEP with their concerns and opposition to the project before the end of FDEP’s Public Comment period, 5:00pm, Friday, 10/31/25. As of 10:30a, Friday, 10/31, a contact at FDEP stated “around 200 complaints” had been received.
